The Consumer Protection Act, 1986 touches every citizen, whether one has actually experienced any trial before the courts established there under or not. The present edition is a light reader for all, with selected collection of precedents, over a broad range of subjects, to highlight the reach of the jurisdiction. Due to the “touch-screen” and “plastic-money” convenience availed by the consumers, there are inevitable aberrations and conflicts caused under e-commerce mode trading activity, and the book attempts to touch the transposition of rights and liabilities under this developing domain. The publishers have retained the digest of cases since the compilation reflects the initial genesis of findings in early years, on diverse topics, and this version is also a connecting link between the current law, and the follow-through edition that will finally adopt the proposed enactment of The Consumer Protection Bill, 2015.
After having enrolled with the Bar Council of Delhi in the year 1988, as a litigation counsel, the author handled briefs involving medical negligence, mediclaims, life insurance claims, and allied matters. He is one of the first non-medical writers on the subject in the country. Trying to create an equilibrium while handling cases from the patient’s side as well the doctor’s, the author’s exposure to the magnitude of health care concepts humbled him further, realizing that issues behind the allegations of professional misconduct by health care providers could not always be termed as trivial, and that in the absence of a well defined code, the precedent based administration of justice was the foundation and strength our jurisdiction, for protection of the rights of the patients, on the one hand, and privileges of the doctors, on the other. The Consumer Protection Act, 1986 virtually became the applied law on the subject, and the author, its permanent student.
